Terms and Conditions

ARTICLE 1 – SCOPE

These General Terms and Conditions apply to the sale of all products (hereinafter referred to as "products") offered on this website (hereinafter referred to as the "site"). The publisher is "FH Shop Deutschland", Tel: +393275870410. Placing an order implies the customer's full acceptance of the site’s terms and conditions, excluding any other terms.

ARTICLE 2 – PRODUCTS

All features of each product are recorded by the customer. Photos on the website are not the responsibility of the seller.

ARTICLE 3 – PRICE OFFERS

Promotional offers are only valid as long as they are online and available. The prices displayed on this website are in Euros, including taxes, excluding shipping costs (see Article 7), and may change during the year, with the products to be paid for at the prices in effect at the time of the order.

ARTICLE 4 – THE ORDER

The order is confirmed by clicking the "Confirm Cart" button. By confirming the order and clicking the "Proceed to Checkout" button, the customer agrees to all of the terms and conditions. The customer's order is confirmed with an acknowledgment, where the order details are sent to the customer’s provided email address. This confirmation will list the exact amount and the shipping method of the order. The seller reserves the right to cancel any order from a customer with payment arrears or a dispute regarding payment of a previous order, or for any other legitimate reason, especially due to the unusual nature of the order.

ARTICLE 5 – AVAILABILITY OF PRODUCTS

The range of products on the website is valid as long as stocks last. If a product is unavailable after the order is placed, the seller must inform the customer within 8 days and provide the expected delivery time for that product. The customer has the option to cancel the order (if payment by bank transfer was made by the customer within 15 days after the order) or exchange the order by contacting the seller via email at info@fhshop24.com.

ARTICLE 6 – PAYMENT

6.1. Payment Methods

The customer must pay for the order using one of the payment methods offered on the website. Transactions on the website are conducted solely in Euros. Online payment by credit card is fully secure.

Ownership of the products remains with the seller until the customer has fully paid for them. The personal data and information you provide are necessary for managing your order and maintaining our business relationships. These may be passed on to companies that assist with these relationships, such as those responsible for performing services and managing, executing, processing, and paying for orders.

This information is also stored for security reasons to comply with legal and regulatory obligations, to improve the services we offer, and to personalize the information we send to you. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, correct, and object to any personal data about you.

6.2. Credit Card Payment Security

The transactions are processed through the websites of Mollie, Stripe, and Paypal, and no card details are stored on fhshop24.com.

ARTICLE 7 – DELIVERY

7.1. Delivery Conditions

The products will be delivered to the shipping address provided during the ordering process. It is the customer's responsibility to provide the correct order details for proper delivery. If the customer is not present when the package is delivered, the customer must arrange a new delivery or collect the package from a designated pickup point. Delivery usually occurs 2 working days after payment for the order and no later than six working days thereafter. Shipping or handling costs are the responsibility of the customer. The delivery date may be extended by seven days upon request from the customer or the seller, and it will be the final delivery date for the ordered product, unless the seller invokes force majeure. After this period, the customer may contact the seller via email to notify the intent to cancel the order, with the full amount refunded within 30 days.

7.2. Exchange or Refund Conditions

If the received product does not match the ordered product or is damaged due to transport conditions, which the customer notices on the day of receiving the package, the seller will exchange or refund the product. The customer must inform the seller via email and indicate whether they want an exchange or a refund by filling out the complaint form available on the website.

Provided the product is returned in its original packaging and in perfect condition to the address provided by the seller via email, the exchange or refund will take place within 30 days after receipt. The product will be exchanged for an identical one from stock or, if unavailable, replaced with a comparable product. If requested, the returned product will be refunded along with the shipping costs once the seller’s liability is confirmed.

ARTICLE 8 – RIGHT OF WITHDRAWAL

The consumer has a period of fourteen days to exercise the right of withdrawal without giving any reason or incurring penalties, except for the return shipping costs. In case the consumer is moving and requires immediate services or necessary living conditions, they may waive this period. In this case, they can still exercise the right of withdrawal without giving reasons or penalties. The withdrawal period mentioned in the previous paragraph starts from the receipt of the goods or acceptance of the service offer. If the provided information is not given, the withdrawal period is extended to three months. If the information is provided within three months after the receipt of the goods or acceptance of the offer, the fourteen-day period will begin as mentioned in the first paragraph. If the seven-day period ends on a Saturday, Sunday, or public holiday, it will be extended to the next working day.

ARTICLE 9 – WARRANTY AND LIABILITY

The customer is entitled to the legal warranty against hidden defects. The seller is not responsible for non-fulfillment of the contract in the case of product unavailability (temporary or permanent), force majeure, malfunction, or total or partial strikes by postal services, transportation, and/or communication services. The seller is not liable for damages arising therefrom, such as business losses, loss of profits, loss of opportunities, damages, or costs.

ARTICLE 10 – DATA PROTECTION AND PRIVACY

The data entered by the customer when placing the order is processed by computer and is required for the creation of the contract. The customer has the right to object to access and to correct data about them held by the seller, as well as the service providers they use. To exercise this right, the customer must send their request to info@fhshop24.com.

ARTICLE 11 – CHANGES TO THE TERMS AND CONDITIONS

Due to the possible development of the site, the seller reserves the right to modify these terms and conditions at any time. The new terms and conditions will be communicated to the customer through an online change and will only apply to orders placed after the change.
